Can I sell my house or condo while it is rented ?

Oh Boy, maybe I am wrong but I doubt this very much.

Got an offer on one of my condo listings. The owner used it as a second home and whenever he is not here he rents it out for a few months to vacationers.

So, this listing already had a rental agreement in place, signed and paid in full. The renters are supposed to move in two weeks after closing.

In the beginning the buyer's agent told me how thrilled the buyer was that rental income for the first 3 month is already secured.

So, when I got the offer, I could not find the "existing rental" addendum. I called the realtor up and asked her to add it.

She strictly refused and asked me what I was thinking. After all, that only applies when the renters live in the unit at the day of closing. I told her that we need to make the rental agreement part of the contract, otherwise my seller can take the renters somewhere else.

All my explaining did not help, SHE WAS RIGHT. After a while I just gave up, because I work for the seller and he has a second unit that the renters like even better. So, I am not doing any harm to my seller, the opposite, I am giving him 3 month of rental income.

This should be an interesting closing. I just have the feeling that the buyer might want to get the lease and the money when we sit at the table.

I have e mails to prove that I made her agent aware of the situation. My seller is prepared to give the rental to the buyer, but please, do we need this headache?

So, again

What do you do?

Start a huge drama about the addendum with the buyer's agent - and get everbody mad

Or

Just let it go?

I think that you know what is right. Unfortunately you are having to work with a agent that is not as willing to see the forest for the trees. Good luck.

I would be afraid of signing that deal.  I would not want to be the renter
