Can I sell my house or condo while it is rented ?

Oh Boy, maybe I am wrong but I doubt this very much.

Got an offer on one of my condo listings. The owner used it as a second home and whenever he is not here he rents it out for a few months to vacationers.

So, this listing already had a rental agreement in place, signed and paid in full. The renters are supposed to move in two weeks after closing.

In the beginning the buyer's agent told me how thrilled the buyer was that rental income for the first 3 month is already secured.

So, when I got the offer, I could not find the "existing rental" addendum. I called the realtor up and asked her to add it.

She strictly refused and asked me what I was thinking. After all, that only applies when the renters live in the unit at the day of closing. I told her that we need to make the rental agreement part of the contract, otherwise my seller can take the renters somewhere else.

All my explaining did not help, SHE WAS RIGHT. After a while I just gave up, because I work for the seller and he has a second unit that the renters like even better. So, I am not doing any harm to my seller, the opposite, I am giving him 3 month of rental income.

This should be an interesting closing. I just have the feeling that the buyer might want to get the lease and the money when we sit at the table.

I have e mails to prove that I made her agent aware of the situation. My seller is prepared to give the rental to the buyer, but please, do we need this headache?

So, again

What do you do?

Start a huge drama about the addendum with the buyer's agent - and get everbody mad

Or

Just let it go?

Closing a real estate deal while you are out of the country

The concept of time. I just know, if I yell at him I will never close this deal and my buyer wants the unit badly, if I don't yell at him, we won't close either because we will run out of time. So, what do you do? No, I did not take a valium and call it a day. I actually very calmly tried to explain the situation to the Title agent and desperately tried to make him understand. It is a mail away to the buyer. Buyer is in East Europe; even UPS has sometimes difficulties getting there. So, the overnight might take 2 days to get there, one day for the buyer to sign and get papers notarized and two days for them to get back to us. Makes a total of 5 business days. If we want to close on Friday the paperwork has to go out by Monday at the very latest. The Title agent keeps telling me, No problem once I have the missing information from the seller, I can close in 24 hours. I explained it again and he said, you are right, but not a problem "TRUST ME" I can close in 24 hours. I explained it a third time, same response. I gave up and called my buyer, telling him the story and saying I am at the end of my rope here I have no clue what else I can possibly say, and asking him to call the title agent himself. He did, and was also told, not to worry, it will all work out, "I can close within 24 hours" This is going on for two weeks now, Title agent still wants to close on Friday and it is Wednesday today. Yes, I have tried to call someone else in the company but no answer. My buyer got mad in the fist few days, now he just thinks it is totally hilarious. We are both at a lost of words. So much for "Closing a real estate deal while you are out of the country"

Waterfront condo for sale in Treasure island, easy to show.

It said in the MLS description "easy to show" just call listing agent.

So I did, his voice mail told me that the number had changed and to dial. . .. and I did, just to get another voice mail saying he can not get any messages on this phone but to call the co listing agent. I did and got another voice mail, so I left a message, "I want to show your unit tomorrow afternoon around 3 pm, please call me back and confirm" Nobody call me back so I called their office phone number, no answer and no even a voice mail. "Waterfront condo for sale in Treasure Island, easy to show." Well I am getting a little disturbed by now.

Made 2 more phone calls to co listing agent and left messages. (By now I am mad and the situation is just ridiculous) He finally called me back to tell me that it is a number lock box and that he does not have the code and needs to get in touch with the listing agent to get it. (yes, you could here my frustration in my response) anyway, shortly before 3 pm the next day both agents separate from each other called me back to tell me, sorry it is a regular electronic Lockbox, no code needed,  just go show it. (I was out of words by than)

So, here comes my client we went into the building up to the 3rdfloor, found the unit, BUT no lockbox. Here I am, calling both agents, again leaving messages. Long story short, they had forgotten to mention the Lockbox is on the ground floor outside by the mailboxes. How I found this out? Well a neighbor overheard me leaving the messages and he told me, that he saw one of this grey Realtor things downstairs. Oh, and one of the agents actually returned my phone call the next day.

So much for  "Waterfront condo for sale in Treasure Island, easy to show."
